Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between Action State Group, Inc. ("Company," "we," "us," or "our") and you ("User," "you," or "your") concerning your access to and use of the GetGopher AI service via text message, email, and website (the "Service").
1. Acceptance of Terms
By accessing the Service, you agree to be bound by these Terms. If you do not agree, you must immediately cease all use of the Service.
2. Eligibility & Account
You must be at least 18 years old to use this Service. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
3. Trial and Paid Services
- Trial Usage: We may offer a "Beta" or "Trial" version of the Service. Trial versions are provided "AS IS" and "AS AVAILABLE" without any warranty, support, or indemnity. Action State Group, Inc. reserves the right to terminate or modify Trial access at any time without notice.
- Paid Subscriptions: Fees are non-refundable. Subscriptions auto-renew unless canceled prior to the renewal date. We reserve the right to change pricing upon notice.
4. SMS & Mobile Communications (A2P Compliance)
By providing your phone number and replying YES to our welcome message, or by clicking “Text Hello to start” on our consent page at getgopher.ai/sms-consent, you expressly consent to receive SMS/MMS messages from the GetGopher Messaging Program, operated by Action State Group, Inc.
- Program Description: GetGopher is an AI business assistant that communicates with users exclusively via SMS. Transactional messages include assistant responses, scheduling confirmations, follow-up reminders, task updates, and billing notifications. Message frequency varies based on your usage.
- Opt-Out (Transactional): You can cancel the SMS service at any time. Text “STOP” to 1-218-438-4674. After sending STOP, we will confirm your unsubscription. You will no longer receive assistant messages.
- Opt-Out (Marketing): To opt out of promotional messages only, text “STOP PROMO” to 1-218-438-4674. This does not affect your transactional assistant messages.
- Support: For help, text “HELP” to 1-218-438-4674 or email support@getgopher.ai.
- Disclosures: Carriers are not liable for delayed or undelivered messages. Message and data rates may apply. Message frequency varies.
5. AI Service Disclaimer (Accuracy & Liability)
- Nature of AI: GetGopher utilizes artificial intelligence and large language models. You acknowledge that AI-generated content may occasionally be inaccurate, incomplete, or biased.
- No Professional Advice: The AI agent is a business productivity tool and does not provide legal, medical, or financial advice.
- Assumption of Risk: You use all AI-generated outputs at your own risk. Action State Group, Inc. is not liable for any damages resulting from reliance on AI outputs.
6. Intellectual Property & Data
- User Content: You retain ownership of the data you input. However, you grant us a worldwide, royalty-free license to use de-identified data to train and improve the Service.
- Company Property: The Service, its underlying AI logic, and "GetGopher" branding are the exclusive property of Action State Group, Inc.
7. Limitation of Liability
To the maximum extent permitted by law, Action State Group, Inc. shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim arising out of these Terms shall not exceed the amount paid by you to us in the six (6) months preceding the claim.
8. Termination
We reserve the right to suspend or terminate your access for any reason, including violation of these Terms or non-payment, at our sole discretion.
9. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
